Questions can arise in area of:

– legalisation of documents;

– remittance for authorised capital forming;

– registration of legal address, etc.

However the Belarus legislation allows to solve this questions quickly. Terms of registration of the legal entity depend on desire of the client, the list of the legal services connected with foundation and registration. The minimum term constitutes only one day.

Therefore sometimes there is necessity for recognition and carrying out of the decision of foreign court in the territory of Belarus.

This aspect is regulated by both the national legislation, and the international contracts or agreements. Hence, during the decision of this aspect it is necessary to consider specificity of legal relations of Belarus with each concrete country or  block of the states. Efficiency of recognition and  carrying out of the decision of foreign court also depends on the correct organisation of work in this direction.

Frequently errors at agreement drawing up come to light during judicial proceedings when, for example, the counterpart founds possibility not to pay, because the agreement appears to be actually not concluded because not all essential conditions are specified, or the agreement contradicts the Belarusian legislation.

Before going to the economic court observance of claim (reclamation) order is necessary. However by competently prepared reclamation the necessity of visiting the economic court can be eliminated. The debts could  be extinguished in reply to the reclamation – in Belarus it happens often.

Thanks to such small system of economic justice uniform judiciary practice is supported. The question is only in its knowledge.

Nevertheless, to represent interests of the enterprise should the lawyer, specialising on questions of the economic right as it has the strong specificity. Since April, 2012 to represent interests of the enterprises in economic courts are allowed only the advocates (barristers) or workers of the given enterprises. Other private lawyers don t have such right.

Claim presentation in economic court or objections on the claim should be prepared only after careful analysis of judgements on similar  cases.

Cases of non-payments arise even more often. Frequently legal aid is necessary for the enterprises during their functioning. Delivery, construction, rent, transportation, investment activity  is far not a cycle of questions arising during economic activity. Thus judiciary practice, practice of checks by controlling bodies show, that even above listed directions contain thousand prominent aspects, which must be considered.

Competent consultation will help to avoid judicial proceedings and if they arise ­– to protect the interests in Belarus, not to admit problems in economic activity. And it is pledge of economy of time, money and presence of calmness.
